Users (“User(s), you, your, customer(s), yourself”) and V-Multimart Private Limited and/or its subsidiaries and affiliates (“juzstay, we, us, our”) enter into a legally binding agreement under these terms. These terms govern the use of the website, mobile application, and call centres (collectively referred to as “our Platform”), which allow the User to connect with us in relation to the services provided by Juzstay (“Services”).

Please read these terms carefully before accessing, using, obtaining, or using any Juzstay products or services. If you do not agree with these Terms of Service, you may not use the Juzstay and/or Services. These terms must be read in conjunction with any other terms and conditions that apply to the use of our platform and services.

We reserve the right, at its sole discretion, to modify these Terms of Service at any time. It is your responsibility to keep up to date with the Terms of Use; your continued use of our Platform and Services will be deemed acceptance of these terms and any modifications thereto.

Scope of Services

V Multimart, through Juzstay, provides services related to properties managed and/or owned by third parties (“Channel Partners”) in accordance with the terms agreed upon with Juzstay, as the case may be, to assist Users in obtaining the stay Services right. Juzstay platform provides services to its users by providing products such as, but not limited to: a. Juzstay Hostel b. Juzstay PG accommodation

Eligibility to use

You must be at least eighteen (18) years old and capable of entering, performing, and adhering to these terms. Individuals under the age of 18 may use the service, but only with the involvement, guidance, and supervision of their parents and/or legal guardians, and only through the parent’s or legal guardian’s registered account. We reserve the right to terminate User’s access and refuse to provide User with access to our services if we believe it is necessary.

Using the JUZSTAY Platform: Account Registration and use

JUZSTAY provides the Services to you via the JUZSTAY Platform in exchange for you providing JUZSTAY with certain required User information and creating an account (“Account”) using your JUZSTAY ID and password or another log-in ID and password (collectively, the “Account Information”). To use the Services provided by the JUZSTAY Platform, you must first register as a User by creating an Account. You will be held accountable for maintaining the confidentiality of the Account Information, and are fully responsible for all activities that occur under Your Account. You agree to (a) immediately notify JUZSTAY of any unauthorized use of its Account Information or any other breach of security, and (b) ensure that you exit/log out from the account at the end of each session. JUZSTAY cannot and shall not be liable for any loss or damage arising from your failure to comply with this clause. You may be held liable for losses incurred by JUZSTAY or any other customer or visitor to the JUZSTAY Platform due to authorized or unauthorized use of your account as a result of your failure in keeping its Account Information secure and confidential.

Unregistered users can also gain limited access to the JUZSTAY Platform. You must ensure that the Account Information you provide in the JUZSTAY Platform registration form is complete, accurate, and up to date at the time of registration. It is expressly forbidden to use another user’s account information.

JUZSTAY Services

Juzstay is primarily responsible for providing a hostel stay and ensuring that the services promised by Juzstay to its customers are acceptable. Juzstay has the authority to require hostel owners to provide hostel/room/guest stay services to Juzstay customers.

We understand the needs of the new generation of customers and, as a result, provide a diverse range of hostels on its platform to meet those needs.
We market hostels/PG rooms/Live in/guest house/farmhouse stays, etc., by providing customers with affirmative details and confirmation services and conditions, which entitles them to avail Hostel and allied accommodation service in our service provided by our channel partners in accordance with the terms agreed upon with us.
If customers are unable to select properties from our website, they can call our customer service desk, and our team will assist them in finding a suitable accommodation within their preferred budget and amenities.
We also guarantee its users a comfortable stay in all its hostel rooms by providing corresponding amenities from various service providers.

JUZSTAY stays involved with the users right from searching till the joining of an ensuring accommodation that the User gets

Termination & Term

If you wish to cancel your membership in our service and Platform, you may do so at any time. We have earned the right to terminate your use of our platform without notice or liability if you violate the terms stated herein.

Terms specifically applicable to Customer:

Users who use the JUZSTAY Platform to access Services and JUZSTAY Products (hereinafter referred to as “Customers”) are subject to the following terms and conditions:

Using of services

The process of using the Services on this JUZSTAY Platform may necessitate the disclosure of personal and confidential information. You shall not use/access this site from unsecure computers, unsecure communication links, unsecure mobile phones, or locations such as Internet-Cafe(s), Cyber-Cafe(s), and other commercially available internet enabled computers or computer services to avoid any possibility of unauthorised access to your confidential information such as name, address, etc.

The User agrees, acknowledges, and confirms that before placing any order on the JUZSTAY Platform, the User shall carefully review the Service description and price, and by contacting accommodation provider you agree to be bound by such terms, including the Services’ description.

You will only agree to use the service if you are completely satisfied with the price, description, and appearance as displayed on the JUZSTAY Platform. That relying on declarations, confirmations, information, and obligations made/undertaken by the User in accordance with the terms, and believing the same to be true and acting on that faith,

JUZSTAY has agreed to provide the information to the User on the terms stated herein. In particular, the User agrees, promises, declares, confirms, covenants, undertakes, and represents and warrants to JUZSTAY:

The User is not subject to any legal or other deficiency that prevents/may prevent the User from: I entering into a valid contract under applicable laws; and (ii) making valid payment to JUZSTAY for Services ordered by the User.

If any suspicious activity is detected in the User’s account, JUZSTAY reserves the right to cancel all pending and future orders without liability to the User.
In a credit card transaction, you must use your own credit card, for which you have full right and authority to make payment to JUZSTAY. JUZSTAY is not responsible for credit card fraud. The liability for fraudulently using a card will be on the User, and the onus to “prove otherwise” will be solely on the User.

While using the JUZSTAY Platform, the User must always strictly adhere to the payment procedure and the terms stated herein in their entirety.
Your use of the Services implies that you are completely satisfied with the description, look, and design of the accommodation, as well as the usage fee displayed on JUZSTAY’s Platform.

The User agrees and acknowledges that all Services on the JUZSTAY Platform are provided at JUZSTAY’s sole discretion.

Payment and Usage Charges

You hereby agree and understand that you must pay the usage fee for the relevant Services as specified on the JUZSTAY Platform using the payment method provided on the JUZSTAY Platform. The User agrees and acknowledges that the payment procedure may require additional verification or information from the User, and the User agrees to provide complete, correct, and correct information.

JUZSTAY receives payments from Users through third-party payment providers. JUZSTAY is not liable for any delays, incorrect transaction execution, or cancellation of reservations due to payment issues. JUZSTAY takes great care when working with third-party payment providers, but because it does not control their systems, processes, technology, or work flows, it cannot be held liable for any errors made by payment providers.

Payments for Services provided by the JUZSTAY Platform are made to the entities listed in the Payment for Services tab.

Responsibility

JUZSTAY and its employees are NOT liable for any loss, theft, or damage to service seekers’ personal valuables and belongings at any time.

User / Service seeker’ verification on the Internet is difficult, and we accept no responsibility for confirming any Guest’s identity. Regardless of the foregoing, for the sake of transparency and fraud prevention, and as permitted by applicable laws, we may, but are under no obligation to I request that service seekers provide a form of government identification or other information, or conduct additional checks to help verify the identities or backgrounds of service seekers, (ii) screen service seekers against third-party databases or other sources and request reports from service providers, and (iii) obtain reports from public records of criminal convictions or sex offender registries where we have sufficient information to identify a service seeker (if available).

Usage terms

JUZSTAY is not responsible for and shall not be bound to honour typographical or pricing errors on the JUZSTAY Platform. We reserves the right to refuse or cancel services at any time, including but not limited to services that contain incorrect prices or product descriptions, orders in which we believes the User has violated applicable laws or these terms, and orders in which we believes the User has violated applicable laws or these terms and services that JUZSTAY believes are harmful to JUZSTAY or services that JUZSTAY believes are fraudulent or based on illegal, fraudulent, or deceitful use/furnishing of information or based on false information. JUZSTAY makes no warranties or representations about the quality, accuracy, or completeness of any data, information, product, or Service. Subject to the Services referred to as “JUZSTAY services,” in relation to its platform, expressly disclaims any express or implied warranties regarding the accuracy, completeness, correctness, suitability, reliability, availability, timeliness, quality, continuity, performance, error free or uninterrupted operation/functioning, fitness for a particular purpose, workmanlike effort, non-infringement, lack of viruses or other harmful components of the Services and/or product.

JUZSTAY shall not be liable for any delay or inability to use the JUZSTAY Platform, unrelated functionalities, the provision of or failure to provide functionalities, or for any information, software, services, functionalities, and related graphics obtained through the JUZSTAY Platform, or otherwise arising out of the use of the JUZSTAY Platform, whether based on contract, tort, negligence, strict liability, or otherwise.

Furthermore, JUZSTAY shall not be held liable for non-availability of the JUZSTAY Platform during periodic maintenance operations or any unplanned suspension of access to the JUZSTAY Platform that may occur due to technical reasons or for any reason beyond JUZSTAY’s control. You understand and agree that any material or data downloaded or otherwise obtained through the JUZSTAY Platform is done entirely at your own discretion and risk, and you will be solely responsible for any damage to your computer systems or loss of data that results from the download of such material or data. JUZSTAY accepts no responsibility for any errors or omissions in the information provided to you.

JUZSTAY may condition or restrict access to and use of the JUZSTAY Platform, or specific areas or features of the JUZSTAY Platform, such as completing a verification process, meeting specific quality or eligibility criteria, meeting ratings or reviews thresholds, or a user’s service availed history and cancellation history.

JUZSTAY cannot guarantee the continuous and uninterrupted availability and accessibility of the JUZSTAY Platform due to the nature of the Internet. JUZSTAY reserves the right to limit the availability of the JUZSTAY Platform or specific areas or features thereof if it deems it necessary due to capacity constraints, the security or integrity of our servers, or to carry out maintenance measures that ensure the proper or improved functioning of the JUZSTAY Platform. JUZSTAY reserves the right to improve, enhance, and modify the JUZSTAY Platform as well as introduce new JUZSTAY Services at any time.

JUZSTAY may enable features that allow you to authorise other Users or third-party entities to take actions affecting your JUZSTAY Account. For example, we may allow Users to link their JUZSTAY Accounts to businesses and perform actions on their behalf. We may also allow eligible Users or certain third parties to book listings on behalf of other Users. These features do not require you to share your credentials with anyone. JUZSTAY has authorised no third party to request your credentials, and you shall not request the credentials of another User.

Prohibited Content:

As a condition of using the JUZSTAY Platform, the User warrants to JUZSTAY that the User will not use the JUZSTAY Platform for any unlawful, unauthorised, or inconsistent with these terms, and the User agrees that this licence to use the JUZSTAY Platform will terminate immediately upon User’s breach of this warranty. JUZSTAY reserves the right, at its sole discretion, to suspend or terminate User’s access to the JUZSTAY Platform and its content at any time, with or without notice. The User agrees, acknowledges, confirms, and undertakes that the registration data, information/data provided or uploaded by the User onto the JUZSTAY Platform: a. is not false, inaccurate, misleading, or incomplete; or b. is not fraudulent or involves the use of counterfeit or stolen credit cards; or c. does not infringe any third party’s intellectual property, trade secret, or other proprietary rights, or rights of publicity or privacy; or

not be defamatory, libellous, unlawfully threatening, or unlawfully harassing; or e. not contain any viruses, Trojan horses, worms, time bombs, cancelbots, easter eggs, or other computer programming routines or executable files that may damage, detrimentally interfere with, secretly intercept, or expropriate any person’s system, data, or personal information; or
shall not subject JUZSTAY to liability or cause JUZSTAY to lose (in whole or in part) the services of JUZSTAY’s ISPs or other service providers/suppliers. If the User violates the foregoing, or JUZSTAY has reasonable grounds to suspect that the User has violated the foregoing, JUZSTAY reserves the right to deny or terminate the User’s access to the JUZSTAY Platform indefinitely and to refuse to honour the User’s request (s).

Users are not permitted to do the following: a. Systematically retrieve data or other content from the JUZSTAY Platform in order to create or compile, directly or indirectly, a collection, compilation, database, or directory without our written permission.

Make any unauthorised use of the JUZSTAY Platform, such as collecting user usernames and/or email addresses for the purpose of sending unsolicited email, or creating user accounts through automated means or under false pretences.
Avoid, disable, or otherwise interfere with security-related features of the JUZSTAY Platform, such as those that prevent or restrict the use or copying of any Content or impose restrictions on the use of the JUZSTAY Platform and/or the Content contained therein.
Frame or link to the JUZSTAY Platform without permission.
Defraud, trick, or mislead us or other users, particularly when attempting to learn sensitive account information such as user passwords.
Misuse our support services or file false reports of abuse or misconduct.
Use the system in any automated way, such as by using scripts to send comments or messages, or by using data mining, robots, or similar data gathering and extraction tools. h. Interfere with
Attempt to impersonate another user or person, or use another user’s username
Sell or transfer your profile in any other way.
Harass, abuse, or harm another person using any information obtained from the JUZSTAY Platform.
Use the JUZSTAY Platform in any attempt to compete with us, or use the JUZSTAY Platform and/or the Content in any revenue-generating endeavour or commercial enterprise.
Decipher, decompile, disassemble, or reverse engineer any software that is part of the JUZSTAY Platform in any way.
Attempt to bypass any measures of the JUZSTAY Platform designed to prevent or restrict access to the JUZSTAY Platform, or any portion of the JUZSTAY Platform.
Copy or modify the JUZSTAY Platform’s software, including but not limited to Flash, PHP, HTML, JavaScript, or other code.
Upload or transmit (or attempt to upload or transmit) viruses, Trojan horses, or other material, including excessive use of capital letters and spamming (continuous posting of repetitive text), that interferes with any party’s uninterrupted use and enjoyment of the JUZSTAY Platform or modifies, impairs, disrupts, alters, or interferes with the use, features, functions, operation, or maintenance of the JUZSTAY Platform.
Upload or transmit (or attempt to upload or transmit) any material that functions as a passive or active data collection or transmission mechanism.
Except as a result of normal search engine or Internet browser usage, use, launch, develop, or distribute any automated system that accesses the JUZSTAY Platform, including without limitation any spider, robot, cheat utility, scraper, or offline reader, or using or launching any unauthorised script or other software.
Disparage, tarnish, or otherwise harm us and/or the JUZSTAY Platform in our opinion.
Use the JUZSTAY Platform in a way that violates any applicable laws or regulations.

Communications

When you use the JUZSTAY Platform, you acknowledge that you are talking with JUZSTAY through electronic records, and you consent to JUZSTAY periodically and as needed to communicate with you in this manner. JUZSTAY may contact you by email or through any other kind of communication, whether electronic or not. You expressly acknowledge and accept that JUZSTAY is not liable for any unauthorised access to or alteration of your transmissions or data, any material or data communicated or received or not sent or received, and any material or data of any kind. Additionally, JUZSTAY will do its best efforts to protect the confidentiality of any personally identifiable information you have provided to it, but internet-based transmissions cannot be guaranteed to be secure. By using this JUZSTAY Platform, you agree that JUZSTAY will not be held liable for the disclosure of your information as a result of transmission errors or unauthorised third-party acts. Without limiting the foregoing, you agree that JUZSTAY is not liable or responsible for phishing attacks on you. When you access the JUZSTAY Platform, you have the option to accept or decline cookies. It is the User’s responsibility to configure his browser to notify him when cookies are accepted or rejected.

Third Party Links

Links to JUZSTAY Platforms owned and maintained by individuals or entities other than JUZSTAY may appear on this JUZSTAY Platform, at JUZSTAY sole discretion. In order to allow the Customer to pay JUZSTAY, JUZSTAY may also offer links to other websites. The aforementioned links are merely offered as a convenience and do not imply JUZSTAY’s endorsement of any of the websites they lead to. The information or links presented on these websites are not the responsibility of JUZSTAY. The privacy policies of such websites, which JUZSTAY does not own, manage, or control, are not JUZSTAY’s responsibility. The websites to which this JUZSTAY Platform may be linked do not undergo routine review by JUZSTAY, and JUZSTAY makes no warranty or representation regarding the materials posted, Services, or services given, and JUZSTAY shall not be liable for any inadequacy therein. JUZSTAY expressly disclaims responsibility for the contents of any linked site, the accuracy of any information found there, and the calibre of the Services and services provided at any linked site. JUZSTAY does not endorse any or all the materials, Services, or services made available on such linked sites. The choice to view the contents of any linked site is entirely up to the user, who does so at their own risk.
